Why this legal question matters
An order dated 2 October 2014, reproduced in the Supreme Court administrative collection (2018 №5), addresses admissibility of a declaratory claim. Its procedural context highlights why selecting the correct form of relief matters.
Form of claim, legal interest and admissibility conditions.
What the issue concerns
Form of claim, legal interest and admissibility conditions.
Legal principle from the judgment
The Court explained that a declaratory action is inadmissible where the party can pursue a claim under Articles 22–24 of the Administrative Procedure Code. The availability of a direct damages claim concerning the administrative action made the declaratory form inappropriate under Article 25(2).
Disposition
The private complaint was dismissed and the appellate ruling terminating proceedings was upheld.

Before relying on the decision, compare material facts, the applicable statutory version and procedural posture. The decision concerned historical facts; confirm the law now applicable and distinguish your own circumstances.
Implications when drafting a claim
The correct procedural form depends on the actual remedy sought, not the title of the pleading. Ask whether annulment, performance or damages offers a direct route. Here the availability of another claim limited the declaratory action. The 2014 decision must be considered alongside current procedural law.
How to distinguish procedural remedies
Before filing an administrative claim, define the remedy precisely. Annulment, an order to act and a declaration of a legal relationship are not interchangeable. BS-595-573 illustrates the admissibility risk when a claimant seeks a declaration while a direct remedy exists. Record the challenged act or conduct, desired outcome and statutory procedural route. Do not use a 2014 decision as a substitute for checking today's filing rules.
